Terms of Service

Welcome to Pecan Talent

These Terms of Service ("Terms") govern your access to and use of Pecan Talent's AI-powered resume generation and talent matching platform (the "Service"). By using our Service, you agree to these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing the Service, or using any features of Pecan Talent, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization (e.g., as a recruiter), you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using Pecan Talent, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

a. Account Creation

  • You may create an account using email/password or Google OAuth
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information when creating your profile

b. Guest Mode

You may use certain features of the Service without creating an account ("Guest Mode"). However, your data will be stored locally and not synced across devices. Guest Mode users cannot opt-in to recruiter visibility.

c. Account Security

You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Two User Types: Candidates & Recruiters

Pecan Talent operates a two-sided marketplace with distinct terms for each user type:

5. Terms for Candidates (Job Seekers)

a. Resume Generation Service

  • You may use our AI-powered tools to generate tailored resumes based on your career data and target job descriptions
  • You retain all rights to your career data and generated resumes
  • You are solely responsible for the accuracy of the information you provide

b. Recruiter Visibility (Opt-In)

You Control Your Visibility. By default, your profile is private. You may opt-in to make your profile searchable by recruiters.

  • Opt-In Consent: You may toggle "Make my profile visible to recruiters" in your settings. This allows recruiters who subscribe to our platform to search, view, and contact you.
  • What Recruiters See: If opted-in, recruiters can see your name, work experience, education, skills, and contact information (email, phone, LinkedIn).
  • Opt-Out Anytime: You may disable recruiter visibility at any time. Your profile will immediately become hidden from recruiter searches.
  • No Guarantees: Opting in does not guarantee job offers or interviews. Pecan Talent is a platform for connecting candidates with recruiters, not an employment agency.

c. AI-Generated Content Disclaimer

Our AI tools (powered by OpenAI and Google Gemini) provide suggestions for resume content. You are responsible for reviewing, editing, and approving all generated content before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated resumes for any specific job application.

d. Prohibited Conduct

As a candidate, you agree NOT to:

  • Provide false, misleading, or fraudulent information in your profile
  • Impersonate another person or misrepresent your credentials
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to scrape, harvest, or collect data from the platform

6. Terms for Recruiters

a. Subscription & Pricing

  • Starter Plan: $100/seat/month - Includes unlimited searches, 250 contact credits (email), and 250 export credits
  • Business Plan: Custom pricing - Includes everything in Starter plus onboarding, training, unlimited contact credits, and usage analytics
  • Billing: Subscriptions are billed monthly or annually (as selected). Charges are non-refundable except as required by law.
  • Credit Usage: Contact credits are consumed when you initiate contact with a candidate. Export credits are consumed when you export candidate profiles. Unused credits do not roll over to the next billing period.

b. Access to Candidate Profiles

Consent-Based Access. You may only search and view profiles of candidates who have explicitly opted in to recruiter visibility.

  • Candidates control their visibility. If a candidate opts out, their profile will immediately become unavailable to you.
  • You may use candidate data solely for legitimate recruiting purposes (evaluating candidates for job opportunities).
  • You may not use candidate data for marketing, spam, or any other non-recruiting purpose.

c. Prohibited Conduct for Recruiters

As a recruiter, you agree NOT to:

  • Bulk Data Scraping: Scrape, harvest, or export candidate data in bulk or use automated tools to collect data
  • Reselling Data: Share, sell, or redistribute candidate data to third parties (including other recruiters, data brokers, or marketing companies)
  • Spam or Harassment: Send unsolicited, irrelevant, or excessive messages to candidates
  • Discrimination: Use the platform in a manner that violates anti-discrimination laws (e.g., filtering candidates based on protected characteristics)
  • Circumventing Credits: Attempt to contact candidates outside the platform to avoid using contact credits
  • Misrepresentation: Misrepresent job opportunities, company information, or employment terms

d. Acceptable Use Policy

Recruiters must:

  • Contact candidates professionally and respectfully
  • Provide accurate information about job opportunities
  • Respect candidate privacy and opt-out requests
  • Use the platform in compliance with all applicable employment and privacy laws

e. Account Suspension

We reserve the right to suspend or terminate recruiter accounts that violate these Terms, engage in abusive behavior, or misuse candidate data. Suspended accounts are not eligible for refunds.

7. Intellectual Property

a. Your Content

You retain all rights to the career data, resumes, and content you create or upload to Pecan Talent ("Your Content"). By using the Service, you grant us a limited license to process, store, and display Your Content solely to provide the Service.

b. Our Platform

All rights, title, and interest in the Pecan Talent platform, including software, algorithms, design, and trademarks, are owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. AI Services & Third-Party Integrations

Our Service uses third-party AI models (OpenAI GPT-4o-mini and Google Gemini) to generate and parse resume content. By using the Service, you acknowledge and agree that:

  • Your data may be processed by these third-party services in accordance with their privacy policies
  • AI-generated content is not perfect and may contain errors, inaccuracies, or biases
  • You are responsible for reviewing and approving all AI-generated content before use
  • We do not guarantee the quality, accuracy, or suitability of AI-generated resumes for any specific purpose

9. Disclaimers & Limitation of Liability

a. No Guarantee of Results

Pecan Talent is a platform for creating resumes and connecting candidates with recruiters. We do not guarantee job offers, interviews, or employment outcomes. Your success in the job market depends on many factors beyond our control.

b. Service Availability

We strive to provide a reliable service, but we do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

c. Limitation of Liability

To the fullest extent permitted by law, Pecan Talent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim (or $100 if you have not paid us anything).

10. Termination

a. Your Right to Terminate

You may terminate your account at any time by deleting it through your account settings. If you are a recruiter with an active subscription, you remain responsible for charges through the end of your billing period.

b. Our Right to Terminate

We may suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or for any other reason at our sole discretion. We will provide notice when reasonably possible, but we are not obligated to do so.

c. Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (e.g., liability limitations, intellectual property) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify you of material changes by email or through a notice on the platform. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

If you are a consumer in the European Union, you may also have the right to resolve disputes through the EU Online Dispute Resolution platform.
